Request for Prosecution


The request for prosecution process is uniform across different jurisdictions.

Primary Flow Description
  •  
Law enforcement submits a prosecution request to Prosecution. 
  •  
Prosecution reviews the prosecution request.
  •  
Prosecution makes a charging decision and decides whether to (1) Decline for further investigation; (2) File/amend charge or (3) File no charges. 
 
  •  
If the prosecution decides to decline for further investigation, Prosecution submits the case file back to Law Enforcement. 
  •  
Law enforcement conducts further investigation and decides whether to resubmit a referral for charging. 
  •  
If Prosecution decides to File no charges, process stops. 
  •  
If Prosecution decides to File/amend charges, Prosecution prepares a complaint. 
  •  
Prosecution files a complaint with the Court.
  •  
Court performs a court filing and decides whether to issue a warrant.
  •  
If Court decides to issue a warrant, a warrant is submitted to Law Enforcement.

Law Enforcement serves the warrant. 
  •  
Law Enforcement performs an arrest on warrant.
  •  
Law Enforcement submits an arrest report to Booking. 
  •  
Booking performs fingerprinting. 
  •  
Booking submits fingerprint card to Repository.

Repository records fingerprint card.

If suspect fails to appear, the Court issues a warrant.

If suspect appears, the Court decides whether to fingerprint suspect.

If Court decides to fingerprint suspect, a fingerprint order is submitted to Booking.

Booking performs fingerprinting.

Booking submits fingerprint card to Repository.

Court adjudicates and disposes of charges.
